
The admissibility of evidence (including testimony by expert witnesses) in federal courts is governed by the Federal Rules of Evidence (FRE). Most state courts have adopted evidence rules that are similar to the federal rules. 
How is an expert witness determined?
If the two parties to the case do not stipulate or agree that a person qualifies as an expert witness, there will be a brief hearing to determine whether the person may testify as an expert. Both parties have the opportunity to question the person on knowledge, skill, experience, training, and/or education. The judge makes the final determination as to whether the advocate possesses greater knowledge, skill, experience, training, and/or education than a lay person and may testify as an expert.
An expert witness can be called to testify from any field as it pertains to the case.
Art Therapists are being sought to testify more frequently than before due to the unique perspective offered in their testimony.
Art Therapists utilize the creative experience to assist in the resolution of legal matters that are in dispute. Art Therapist’s are consulted nationally by Law Enforcement agencies to evaluate domestic litigation cases by using comprehensive assessment procedures.
A great deal of preparation goes into involvement for each case. If required I am willing to provide a deposition for either Preservation of evidence or Discovery.
Much research of the files and testing goes into being prepared for testifying, records are reviewed, notes are made as to my thoughts on the information, and I discuss the case with the attorney whom requisitioned my service.
I have served as an Expert Witness in many civil and criminal cases across the United States. As an Art Therapist my ability to “see what the client is seeing and experiencing emotionally, mentally and spiritually often assists in the process of justice.
